Which legislation applies to my website per country?

When offering products or services online, you must comply with the legislation of the countries where your customers are. Below is an overview per country.

Netherlands

Email marketing:

  • Telecommunications Act: opt-in required for commercial emails
  • Double opt-in recommended but not mandatory
  • Unsubscribe link required in every email

Webshop:

  • BW 6:230v: order button must clearly indicate payment ("Place order")
  • 14-day right of withdrawal
  • Chamber of Commerce number and VAT number required

Cookies:

  • Telecommunications Act: consent for non-essential cookies
  • Dutch DPA: "Accept" and "Reject" must be equally prominent

Germany

Email marketing:

  • UWG: double opt-in MANDATORY
  • Without DOI you risk fines and "Abmahnungen"

Webshop:

  • BGB 312j: order button must say "Kostenpflichtig bestellen" (or similar)
  • Widerrufsrecht (14 days, same as NL)
  • Impressum mandatory (TMG)
